就業金卡持有人取得或回復我國國籍者，是否應依本辦法第7條規定註銷就業金卡？或繼續以就業金卡之外國特定專業人才身分居住，免改辦臺灣地區居留證？依據本法第25條規定，允許我國國民兼具外國國籍者，可以外國特定專業人才或就業金卡持有人之身分進入臺灣，並在臺灣居住。

本署回應：
一、就業金卡持有人在我國居留期間如有取得或回復我國國籍等入出國及移民法第32條各款情形之一者，本署應依據本辦法第7條第3款規定，撤銷或廢止其就業金卡。
二、就業金卡係依據外國專業人才延攬及僱用法相關規定所核發，該法第25條對於我國國民兼具外國國籍而未在我國設有戶籍，並持外國護照至我國從事專業工作或尋職者，已明定依該法有關外國專業人才之規定辦理。是以，已持有就業金卡，且符合前揭規定者，仍屬外國專業人才。

1.If the Gold Card holders acquire or restore the R.O.C nationality during the period of residence in Taiwan, the NIA shall revoke or repeal the Gold Card in accordance with the Act 7, The Regulations Governing Employment Gold Card Permit for Foreign Special Professionals, “During the period of residence in the State, the Employment Gold Card holder falls into one of the situations described in various paragraphs of Article 32 of the Immigration Act”
2.The Gold Card is issued in accordance with the Act for the Recruitment and Employment of Foreign Professionals. According to Article 25 of the law, a citizen of the State who concurrently holds foreign nationality and has not established household registration in the State, and who comes to the State as holder of a foreign passport to engage in professional work or to seek employment, shall be treated in accordance with the provisions of this Act pertaining to foreign professionals. Therefore, if you are the Gold Card holders and meet the qualifications mentioned above, you are still defined as “Foreign professional”, according to the Act for the Recruitment and Employment of Foreign Professionals.
